Hereinafter referred to as “ToDoInTheWorld”, “we”, “us” or “our”.

1. Scope

ToDoInTheWorld offers and arranges tours, excursions, activities, rentals, tastings, experiences and other tourism services.

Depending on the experience booked, the service may be:

  • provided or organised directly by ToDoInTheWorld;
  • operated by an independent local supplier; or
  • booked or arranged by ToDoInTheWorld through a third-party supplier.

The experience description, the information displayed during the booking process, any specific product conditions, the applicable cancellation policy and the booking confirmation form part of the agreement with the customer.

If there is any difference between these general Terms & Conditions and a specific condition clearly displayed during the booking process for a particular experience, the specific condition shall prevail, to the extent permitted by law.

2. Making a Booking

The person making the booking must be at least 18 years old and must have authority to make the booking on behalf of all participants included in the reservation.

The customer is responsible for ensuring that the information provided is accurate, including:

  • names;
  • contact details;
  • number and age of participants;
  • selected date and time;
  • any information necessary to participate in the activity.

A booking becomes confirmed when a booking confirmation is issued.

Customers should check their booking confirmation and promptly report any errors.

3. Prices

The applicable price is the price displayed during the booking process.

The experience page will state what is included and, where relevant, what is excluded.

Optional services or additional purchases not included in the booking must be paid separately.

In the event of an obvious technical or pricing error, ToDoInTheWorld may correct the error before the service is provided. The customer will be informed promptly and, where appropriate, given the option to cancel the booking and receive a refund.

4. Payment

Payment is made using the payment methods available during the booking process.

Transactions may be processed through Bókun and the relevant payment service providers.

ToDoInTheWorld does not normally receive or store customers’ complete payment card details.

5. Cancellation Policy

Unless a different cancellation policy is clearly displayed for a specific experience during the booking process, the following standard conditions apply:

Cancellation more than 24 hours before the scheduled starting time:
100% refund of the amount paid.

Cancellation within 24 hours of the scheduled starting time:
No refund.

No-show:
No refund.

The cancellation deadline is calculated according to the local scheduled starting time of the activity.

Some activities may have different cancellation conditions, including, for example:

  • admission tickets;
  • special services;
  • private activities;
  • rentals;
  • transport services;
  • experiences requiring advance financial commitments to suppliers.

Where a different cancellation policy applies, the policy displayed to the customer before payment and applicable to that specific booking shall prevail over the standard policy above.

Nothing in this section limits any mandatory rights available under applicable consumer law.

6. Changes Requested by the Customer

Requests to change the date, time, number of participants or other elements of a confirmed booking are subject to availability.

ToDoInTheWorld will make reasonable efforts to accommodate requested changes but cannot guarantee that a change will be possible.

A change may result in an adjustment to the booking price.

A request for a change does not constitute a confirmed modification until the customer receives confirmation of the new arrangements.

7. Late Arrival and No-Show

Customers are responsible for arriving at the stated meeting point at the time specified in their booking confirmation.

Customers should allow sufficient time for traffic, parking, public transport and locating the meeting point.

Late arrival does not automatically extend the duration of an experience.

If a customer arrives too late to participate safely or without disrupting the activity, the booking may be treated as a no-show.

8. Cancellation or Changes by ToDoInTheWorld or the Supplier

An experience may occasionally need to be cancelled, postponed or modified due to circumstances including:

  • adverse weather;
  • unsafe conditions;
  • vehicle or equipment failure;
  • illness or unexpected unavailability of essential personnel;
  • road, venue or attraction closures;
  • restrictions imposed by public authorities;
  • force majeure;
  • other circumstances making the service impossible or unsafe to provide.

If an experience is cancelled by ToDoInTheWorld or the operating supplier before it begins, the customer will normally be offered, as appropriate:

  • an alternative date;
  • a suitable alternative experience; or
  • a full refund of the amount paid for the cancelled service.

The customer is not required to accept an alternative experience.

Mandatory consumer rights remain unaffected.

9. Weather

Outdoor activities are subject to weather conditions.

Light rain, heat, cold or other normal seasonal weather conditions that do not make the activity unsafe do not automatically entitle the customer to cancel without charge.

The decision as to whether an activity can operate safely is made by ToDoInTheWorld and/or the professional operator responsible for providing the activity.

If the operator cancels because conditions are considered unsafe, Section 8 applies.

10. Participant Responsibilities

Participants must comply with reasonable instructions given by guides, instructors, tour leaders, drivers and activity operators.

Participants must:

  • use any required safety equipment;
  • behave responsibly;
  • comply with applicable laws and regulations;
  • avoid putting themselves or others at risk;
  • respect other participants, staff, animals, property and equipment;
  • provide information reasonably necessary for the safe operation of the activity.

Participation may be refused or terminated if a participant:

  • behaves dangerously;
  • is seriously impaired by alcohol or other substances;
  • refuses to follow safety instructions; or
  • otherwise creates a material risk to themselves or others.

A refund may not be available where participation is refused or terminated for these reasons.

11. Activity Requirements

Some activities may have specific requirements concerning:

  • age;
  • height or weight;
  • physical ability;
  • previous experience;
  • driving licence;
  • clothing;
  • footwear;
  • equipment.

Where applicable, these requirements will be stated in the experience description.

Customers are responsible for reviewing these requirements before making a booking.

12. Minors

Minors may participate only in activities where their participation is permitted.

Where required by the particular experience, minors must be accompanied or supervised by a responsible adult.

Any minimum age requirement displayed in the experience description must be respected.

13. Alcohol

Where an experience includes wine or other alcoholic beverages, alcohol will only be served to persons legally entitled to consume it.

The operator may refuse to provide alcohol where reasonably necessary for legal or safety reasons.

14. Rentals and Equipment

Where bicycles, e-bikes, helmets, GPS devices, vehicles or other equipment are provided, customers must use the equipment responsibly and follow the instructions provided.

To the extent permitted by law, customers may be responsible for loss or damage caused deliberately or through negligent misuse.

Customers will not be responsible for:

  • normal wear and tear;
  • pre-existing damage; or
  • mechanical failure not caused by misuse.

15. Transport

Where transport is included in an experience, participants must respect the scheduled departure times and reasonable instructions of the driver or transport operator.

For operational reasons, the vehicle originally envisaged may be replaced with another suitable vehicle.

16. Independent Suppliers

Some experiences are physically operated by independent local suppliers.

In such cases, ToDoInTheWorld may arrange, market, book or coordinate the service.

The operator physically providing the activity is responsible for performing its own services and complying with the professional, operational and safety obligations applicable to it.

Nothing in this section excludes or limits any responsibility that applicable law places on ToDoInTheWorld.

17. Liability

ToDoInTheWorld will perform its services with the level of care required by applicable law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation would be unlawful, including mandatory consumer rights.

To the extent permitted by law, ToDoInTheWorld will not be responsible for consequences directly resulting from:

  • acts or omissions of the customer;
  • failure to follow reasonable safety instructions;
  • inaccurate information provided by the customer;
  • services independently purchased by the customer and not included in the booking;
  • unavoidable and extraordinary circumstances outside the reasonable control of the parties.

18. Extraordinary Circumstances and Force Majeure

Events outside the reasonable control of ToDoInTheWorld or the supplier may affect the provision of a service.

Such events may include severe weather, natural disasters, fires, strikes, civil disturbance, governmental measures, unexpected road closures or similar extraordinary circumstances.

In such circumstances, any remedies, refunds or assistance required by applicable law and the conditions of the specific booking will continue to apply.

19. Travel Insurance

Travel insurance is not included in the price of an experience unless expressly stated otherwise.

Customers are strongly encouraged to obtain appropriate travel insurance covering, where relevant:

  • cancellation;
  • medical expenses;
  • personal accident;
  • travel disruption;
  • loss or damage to personal belongings; and
  • the activities they intend to undertake.

20. Bookings Made Through Viator, GetYourGuide or Other Platforms

Where a ToDoInTheWorld experience is booked through Viator, GetYourGuide or another authorised distribution platform, the terms, conditions and procedures applicable to bookings made through that platform may also apply.

Requests for changes or cancellations should normally be made through the same platform through which the booking was made.

Where the cancellation policy displayed by the distribution platform at the time of booking differs from ToDoInTheWorld’s standard cancellation policy, the conditions communicated to the customer for that specific booking will apply, subject to mandatory consumer rights.

21. Complaints

If a problem occurs during an experience, customers should inform ToDoInTheWorld or the operating supplier as soon as reasonably possible so that an opportunity can be given to resolve the issue.

Complaints made after an experience may be sent to:

info@todointheworld.com

Please include, where possible:

  • booking reference;
  • customer name;
  • experience;
  • date;
  • description of the issue.

Nothing in this section restricts statutory consumer rights.

22. Package Travel

These Terms & Conditions are primarily intended for individual tours, excursions, activities, rentals and other standalone tourism services.

Where a booking legally constitutes a package or another regulated travel arrangement under applicable Irish or European package travel legislation, all mandatory statutory rights and protections applicable to that arrangement shall continue to apply.

Where required by law, additional pre-contractual information and specific package travel conditions will be provided.

Nothing in these Terms & Conditions is intended to exclude or reduce such statutory rights.

23. Privacy

Personal data is processed in accordance with the ToDoInTheWorld Privacy Policy and applicable data protection legislation.

24. Consumer Rights

Nothing in these Terms & Conditions excludes, limits or reduces any mandatory rights available to consumers under Irish law or applicable European Union law.

If any provision of these Terms conflicts with a mandatory consumer right, that mandatory right shall prevail.

25. Governing Law

These Terms & Conditions are governed by the laws of Ireland.

This choice of law does not deprive consumers residing in another country of any mandatory consumer protections applicable to them under the laws of their country of residence.

Any dispute shall be subject to the jurisdiction of the competent courts in accordance with applicable Irish and European law.
